The European Commission, in its report assessing Ukraine's readiness for EU membership negotiations, has identified significant shortcomings in Ukraine's current Law on Urban Planning. The report specifically addresses concerns with Law No. 5655, which has been pending the President's signature for a year.
The law, according to the Commission's analysis, falls short of European standards, particularly in the areas of responsibility and regulatory control within the urban planning sector in Ukraine. A key issue identified is the lack of enforceable controls and accountability for violations, which can lead to detrimental outcomes for citizen-investors.
Furthermore, Bill No. 5655 is critiqued for failing to address existing industry problems and potentially facilitating corrupt practices in insurance-related aspects of urban planning. The proposed insurance types under this law are voluntary rather than mandatory, and the creation of an institution of independent controllers with inadequate coverage for substantial losses is seen as problematic.
The European Commission's observations underscore the need for Ukraine to implement transparent and effective control mechanisms in its construction and urban planning sectors, aligning with European standards and practices.
